The parties agree that any dispute arising out of or in connection with these Terms, subject to the Arbitration clause in 21.2, shall be submitted to the competent court in Eindhoven, The Netherlands.

21.2 MANDATORY BINDING ARBITRATION: Any legal controversy or claim arising from or relating to these Terms of Service or your use of the Site or any purchased product, excluding any claims brought by us for injunctive or other equitable relief, shall be settled solely by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association (AAA) or any agreed-upon arbitration service.

21.3 WAIVER OF CLASS ACTION AND JURY TRIAL: YOU AND SRIFF VOF AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Both parties hereby waive the right to a trial by jury.
